1. Acceptance of the terms

By accessing or using Azonova Sites, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, do not use the service.

2. Eligibility and authority

• You must be legally capable of entering into binding agreements.
• You must provide accurate and complete information when creating an account.
• If you act for a company or organization, you confirm you are authorized to bind that entity.

3. Services

Azonova Sites provides tools to create, host, and manage websites, domains, and subscriptions. We may update, add, or remove features at any time.

Some features may be released as early access or beta features. These may be incomplete, changed, or removed without prior notice.

4. Accounts and security

• You are responsible for all actions taken through your account.
• Keep credentials confidential and use strong authentication practices.
• Notify us immediately of unauthorized access or suspected compromise.
• If you share workspace access with teammates or members, you remain responsible for permissions granted.

5. Customer content and licenses

You retain ownership of the content you upload or publish. You grant Azonova a non-exclusive, worldwide license to host, store, modify, and display your content solely to operate, maintain, and improve the service.

You are responsible for ensuring your content is lawful and does not infringe third-party rights.

6. Acceptable use and anti-abuse

• Use the platform only for lawful and legitimate business purposes.
• Do not distribute malware, spam, fraudulent, deceptive, or abusive content.
• Do not attempt unauthorized access, interference, scanning, or circumvention of security controls.
• Do not use the service in a way that may materially degrade platform stability, reliability, or security.

7. Advertising and branding

Azonova may display branding, promotional badges, or advertising on websites created through the service. This may appear in site headers, footers, or other placements depending on your plan or configuration. We may update these placements from time to time.

8. Subscriptions, billing, taxes, and renewals

• Paid plans renew automatically unless canceled before renewal.
• Prices, fees, and taxes (including GST) may apply where required.
• Payment processing is handled by third-party providers, including Razorpay.
• If payment fails, is reversed, or is disputed, we may suspend or restrict affected services until dues are cleared.
• It is your responsibility to maintain valid payment methods and ensure sufficient funds for renewals.

9. Cancellations and refunds

You may cancel at any time. Refunds, if any, are governed by our Refund Policy.

10. Domains and third-party services

You are responsible for the domains you connect and for complying with domain registry, DNS provider, and registrar policies.

Our services rely on third-party infrastructure and platforms (for example, hosting, source control, or payment partners). We are not responsible for downtime, policy changes, or failures caused by third-party systems.

11. Service availability, changes, and end-of-life

We aim to provide reliable service but do not guarantee uninterrupted or error-free availability. Maintenance windows, third-party dependency issues, internet incidents, and force majeure events may affect service continuity.

We may modify, discontinue, or sunset specific features or services when needed for security, technical, legal, or product reasons.

12. Intellectual property and feedback

Azonova and its licensors retain all rights, title, and interest in the platform, software, design systems, trademarks, and related materials.

If you share ideas, suggestions, or feedback, you grant us a non-exclusive, royalty-free right to use that feedback to improve our products and services.

13. Suspension and termination

We may suspend, restrict, or terminate access where needed to enforce these terms, respond to legal obligations, investigate abuse, prevent fraud, or protect users, infrastructure, and business integrity.

To the fullest extent permitted by law, Azonova may also suspend, limit, remove content, or terminate any account, website, domain linkage, or service access at its sole discretion, with or without prior notice, for any or no reason.

Termination or suspension may result in restricted access to account data, publishing workflows, domains, and related features.

14. Data deletion requests and retained records

You may request deletion of data associated with your use of the service, including site data, uploaded media, imported Instagram data, Google Maps or Google Places sourced content, uploaded documents, and related generated site content, subject to technical and legal limitations.

We may ask for enough information to verify identity and locate the relevant data, such as account email, site IDs, URLs, connected usernames, or upload context.

We may retain limited records where reasonably necessary for security, prevention of fraud or abuse, billing, taxation, dispute resolution, legal obligations, enforcing our policies, or maintaining minimal audit trails around the deletion request itself.

15. Warranties disclaimer

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of liability

To the extent permitted by law, Azonova will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities.

Our aggregate liability relating to these terms and services will be limited to the amount paid by you to Azonova for the affected paid services during the twelve months preceding the event giving rise to the claim.

17. Indemnity

You agree to defend, indemnify, and hold Azonova and its affiliates, team, and service partners harmless from claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your content, your use of the services, your violation of these terms, or your infringement of third-party rights.

18. Governing law and dispute resolution

• These terms are governed by applicable laws of India, subject to mandatory local laws.
• Parties will first attempt to resolve disputes through good-faith discussion.
• If unresolved, disputes shall be submitted to competent courts in India, unless mandatory law requires otherwise.

19. Updates to these terms

We may update these Terms of Service from time to time. Material updates may be notified through product communication channels. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
